Indian Law Society’s Centre for Arbitration and Mediation (ILSCA) is located on the Law College Road, Pune. ILSCA is the only arbitration and mediation venue, attached to an educational institution, ILS, which imparts legal education in the entire country. ILSCA is the only venue available in Pune where arbitral proceedings and mediation proceedings are conducted in comfort.

The 2nd floor of the building designated to ILSCA covering approximately 7,000 sq feet, houses the facilities related to arbitral or mediation proceedings. The infrastructure on the 2nd floor of the building is assigned for the purpose of conducting Arbitration and Mediation Proceedings and comprises of six hearing rooms - three big rooms and three small rooms.The premises designated to conduct arbitral proceedings and mediation proceedings comprises of 6 hearing rooms, 3 big rooms and 3 small rooms. The three small rooms can also be converted into break-out rooms for the arbitrators and/or mediators, if needed.There is also a separate lounge for the comfort of the parties and arbitrators and mediators.

The three big Rooms (Samatha, Vivachan and Mimansa) are equipped with state-of-the-art video conferencing facilities. Each room is equipped with state-of-the-art video conferencing facilities.

ILSCA also has a big conference room which can accommodate 100 pax.

ILSCA can provide transcription services if required on payment of charges.

Terms and Conditions


Terms and Conditions for the usage of the Arbitration and Conference Room at ILSCA
  • Rooms shall be given only for holding conferences, arbitrations, mediations & meetings and for no other purpose.
  • The users of the arbitration and conference rooms should take reasonable care and ensure that the furniture and décor of the rooms are not damaged. This is to maintain the quality and standard of the arbitration and conference rooms at ILSCA to benefit all future users.
  • Smoking and consumption of alcohol is not permitted on the premises.
  • The ILSCA reserves the right to restrict and regulate the entry of persons into the Centre and to adopt appropriate and necessary security measures. The Client shall intimate in writing to the ILSCA, preferably at least one day before the intended use of the Centre, a list of the Client’s Invitees, who shall be provided access to the Centre on the dates of the Confirmed Booking, subject to compliance of security procedures put in place by the ILSCA.
  • The Client and the Client’s Invitees, if any, shall be entitled to use the rooms, facilities and services hired by the Client between 9 a.m. and 6 p.m. on the dates of the Confirmed Booking.
  • Any extension of time in the usage of the rooms, facilities, and any other services shall be according to terms agreed upon between the ILSCA and the Client.
  • The ILSCA reserves the right to refuse the Client and the Client’s Invitees, if any, entry into the reserved rooms or access to the booked facilities and services unless the Client has paid all relevant charges.
  • The Client and the Client’s Invitees, if any, shall vacate the Centre before 6 p.m. Should the Client or the Client’s Invitees require the use of any rooms, facilities, or services beyond 6 p.m. notice must be given to the ILSCA staff at least 4 hours in advance of the start of the intended use, and extra charges shall be levied in addition to the Quoted Prices.
  • The ILSCA shall take all reasonable steps to ensure that the use of the Centre by the Client or the Client’s Invitees is not disrupted or interfered with by any other user of the Centre.
  • The Client shall be responsible for ensuring that all hired items from the ILSCA are restored to the same good working order and condition as at the start of the period of hire by the Client. The Client shall be responsible to the ILSCA for any loss or damage caused to any of the ILSCA’s premises and property by the Client or the Client’s Invitees.
  • The Client undertakes to use the rooms and facilities of the Centre strictly for the purpose for which they are hired and not to do or permit to be done anything in the rooms or in respect of the facilities which will in any way interfere with the use of the Centre and its facilities by other persons, and not to use the premises for any unlawful or immoral purposes.
  • The Client undertakes to indemnify the ILSCA fully for any loss or damage sustained by the ILSCA because of a breach of this undertaking by the Client or the Client’s Invitees.
  • The ILSCA reserves the right to refuse entry to or to immediately eject from the Centre any person whose presence is, in the ILSCA’s opinion, undesirable and whose conduct is objectionable, disorderly or disruptive or in violation of any laws, without compensation to the Client, the Client’s Invitees or any individual.
  • The ILSCA reserves the right to provide any alternate room if necessary due to unforeseen circumstances if the reserved room is unavailable at that particular time.
  • If ILSCA is prevented from conducting business at the whole or a part of the Centre as a result of any damage caused or threatened to the Centre or any other event or circumstance outside ILSCA’s control, the ILSCA shall be entitled to cancel the whole or a part of facility and service provided to the users, and ILSCA shall not be liable for any loss suffered by the Client or the Client’s Invitees as a consequence.
  • The ILSCA accepts no responsibility for any loss or damage to items brought to the Centre by a Client or a Client’s Invitees. Items shall be stored at the Client’s or the Client’s Invitees’ sole risk in the areas allotted to the Client and must be removed immediately at the end of the hire period.
  • The ILSCA reserves the right to charge the Client for any period when the Client or its property, or the Client’s Invitees or property, remains on the Centre after the period of hire at a rate that the ILSCA determines is a reasonable rate in the absolute discretion of the ILSCA. The Client undertakes to pay the total amount of such charges as set out in an invoice from the ILSCA to the Client. The ILSCA also reserves the right to remove and store or dispose of such items at the Client’s risk and expense, including using on-site storage facilities and document shredding services.
Other Conditions
  • Any dispute(s) arising out of or in connection with the Terms & Conditions of Use, including any question regarding its existence, validity or termination, shall first be referred to mediation in Pune by a Mediator to be appointed by the ILSCA.
  • If such dispute(s) cannot be settled by mediation within 15 days of the Client or the ILSCA giving written notice of a dispute to the other party, then the disputes shall be referred to and resolved by a mutually agreed Sole Arbitrator and the arbitration shall be administered by the ILSCA Rules at ILSCA.

Refund and Cancellation Policy


Cancellation
  • If a tax invoice is raised by ILSCA and sent to the party/advocate and the payment is not made before the commencement of the arbitration proceedings, the booking shall be cancelled automatically.

On Postponement of the date for a future date
  • After payment is made and if the party/advocate sends communication before the date of the arbitration hearing about the postponement of the arbitral proceedings for another date, then ILSCA will adjust such payment for the next booking only after deducting Rs.1000 towards administrative charges to issue a new tax invoice for the next date.
Refund
  • If cancellation is made on the hearing date, No refund
Force Majeure
  • Certain circumstances beyond the control of either party, such as natural disasters or unforeseen emergencies, may be considered force majeure events. In such cases, cancellation policies may be more flexible, and parties may be eligible for a full or partial refund.
